These Terms of Service ("Terms") govern your access to and use of NextSay, including our applications, website, and related services (collectively, the "Service"). By creating an account, downloading the app, or using the Service, you agree to these Terms.
1. Eligibility and Accounts
- You must provide accurate account information and keep your login credentials secure.
- You are responsible for all activity under your account.
- If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Recording, Transcription, and Consent
You are solely responsible for complying with all laws that apply to recording, monitoring, or transcribing conversations.
- You must obtain any required notice or consent from participants before recording or transcribing a conversation.
- You are responsible for your own use of transcripts, summaries, action items, mind maps, and any related output.
3. The Service
NextSay provides conversation assistance, transcription, summaries, note-taking, and related workflow features. Features, limits, and availability may change over time.
- Some features require microphone access, network access, or an active account.
- Some features depend on third-party services, subscription tier, or usage limits.
- We may add, remove, suspend, or modify features at any time.
4. Subscriptions, Billing, and Limits
- NextSay offers free and paid access tiers, and the exact feature set or usage limits may vary by plan.
- Paid subscriptions and entitlements may be managed through app stores or authorized billing providers.
- Paid plans renew automatically unless cancelled according to the billing platform's rules.
- You are responsible for reviewing pricing, renewal, cancellation, and refund terms presented at purchase.
5. Acceptable Use
You may not use the Service to:
- violate law or the rights of others;
- record or process conversations unlawfully;
- bypass security controls, quotas, or subscription restrictions;
- abuse, disrupt, probe, or interfere with the Service or its providers;
- use the Service to generate or facilitate fraud, harassment, defamation, or other harmful conduct.
6. Your Content and Our Rights
- You retain ownership of the content you submit or create through the Service.
- You grant us a limited, non-exclusive right to host, process, transmit, and analyze your content solely to operate, secure, maintain, and improve the Service.
- You represent that you have the rights needed to submit that content and allow us to process it.
7. AI Output and Accuracy
NextSay includes automated transcription and AI-generated output. Those systems can be wrong, incomplete, biased, or out of date.
- Transcripts, summaries, action items, mind maps, and guidance are provided for convenience.
- You remain responsible for reviewing and validating outputs before relying on them.
- NextSay does not provide legal, medical, financial, or other professional advice.
8. Intellectual Property
- NextSay and its software, branding, designs, and proprietary systems remain our property or the property of our licensors.
- These Terms do not give you ownership of the Service itself.
9. Suspension and Termination
- We may suspend or terminate access if you violate these Terms, create security risk, misuse the Service, or if we are required to do so by law.
- You may stop using the Service at any time. If you can still access your account, you may delete it through available authenticated account controls. If you cannot access your account, you may request deletion by contacting support from the email associated with your account, subject to verification.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
11. Limitation of Liability
To the maximum extent permitted by law, NextSay and its affiliates, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or use arising from or related to the Service.
12. Governing Law
These Terms are governed by the laws of the jurisdiction specified by NextSay, excluding conflict-of-law principles. If we publish a more specific governing law or venue statement later, that statement will control.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after updated Terms become effective means you accept the revised Terms.
